Agreement to Terms
By engaging the services of Tax Solutions SA ("we", "our", or "us"), you agree to be bound by these Terms of Service. Please read these terms carefully before using our services.
Our Services
Tax Solutions SA provides professional accounting, tax, and business advisory services including but not limited to:
- Tax return preparation and lodgement
- Business Activity Statement (BAS) preparation
- Bookkeeping services
- SMSF administration and audit
- Business advisory services
- Financial planning assistance
Professional Standards
Our services are provided in accordance with the professional and ethical standards set by the Institute of Public Accountants (IPA). We maintain current professional registration and comply with all relevant professional obligations.
Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information necessary to perform our services
- Inform us of any changes to your circumstances that may affect our services
- Respond promptly to requests for information or clarification
- Keep copies of all documents provided to us
- Pay invoices within the agreed timeframe
- Inform us if you believe there are any errors in our work
Confidentiality
We treat all client information as confidential and will not disclose it to third parties except:
- As required by law or regulatory authorities
- To the Australian Taxation Office as part of our services
- With your express consent
- To our professional advisers under duty of confidentiality
Fees and Payment
Our fees are based on the complexity of the work and time involved. We will provide you with a fee estimate before commencing work where possible. Our payment terms include:
- Invoices are payable within 14 days of issue unless otherwise agreed
- For ongoing services, we may require payment in advance or regular payments
- We reserve the right to charge interest on overdue accounts
- We may retain documents until outstanding fees are paid
Limitation of Liability
Our liability for any loss or damage arising from our services is limited to the fees paid for those services, except where liability cannot be limited by law. We are not liable for:
- Losses arising from information you provided that was incomplete or inaccurate
- Losses arising from your failure to act on our advice
- Indirect or consequential losses
- Penalties or interest imposed by the ATO where you have not provided information in a timely manner
We maintain professional indemnity insurance as required by our professional body.
Intellectual Property
All reports, advice, and other materials we produce remain our intellectual property until payment is received in full. You may use these materials for the purpose for which they were prepared but may not reproduce or distribute them without our consent.
Communication
We may communicate with you via email, telephone, or post. You acknowledge that email communication carries inherent security risks and consent to us communicating with you via email. We will take reasonable precautions to protect confidential information sent electronically.
Termination
Either party may terminate the engagement by providing written notice. Upon termination:
- You are responsible for fees for work completed up to the termination date
- We will return your documents upon request and payment of outstanding fees
- We may retain copies of documents as required by professional standards
Conflicts of Interest
We will advise you if we become aware of any conflict of interest that may affect our ability to provide services to you. In such cases, we will discuss the options available and may need to cease acting if the conflict cannot be managed appropriately.
Complaints
If you have any concerns about our services, please contact us immediately so we can address them. If you are not satisfied with our response, you may lodge a complaint with the Institute of Public Accountants.
Governing Law
These terms are governed by the laws of South Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
Changes to Terms
We may update these Terms of Service from time to time. We will notify you of any material changes. Your continued use of our services after any changes indicates your acceptance of the new terms.
